Albany Vacant Property Ordinances

 Albany Vacant Property Registration Ordinance

The following briefly summarizes the Albany ordinance regarding registration of vacant properties with the city.

Section 133-78-3. Vacant building registration.
This provision requires an owner to register buildings within 30 days of becoming vacant or being notified by the owner of the requirement to register the building. The building must be re-registered within 30 days upon a transfer of ownership.

The registration must include: a description of the premises; the names/addresses of the owner(s); if the owner is not a resident of Albany, the name of the third party with whom the owner has contracted to manage the property; names/addresses of all lienholders; a telephone number where a responsible person can be reached at all times; and, a vacant building plan.

The vacant building plan must include information regarding the demolition, securing and maintenance, or the rehabilitation of the property. The code enforcement officer has authority to approve the plan and any written variations to the plan that are submitted.

There is a $200 annual fee assessed for registering vacant buildings.

Section 133-68. Exterior protection.
This section details the steps maintenance required for the exterior protection of the property.

Section 133-80. Penalties for offenses.
If a person was served with an order to remedy a violation of these provisions and is convicted of a failure to do so, then a fine of up to $1,000 or one year imprisonment may be assessed. Each day a violation continues constitutes a separate offense. A copy of the ordinance is attached for your review.

The City of Albany was contacted regarding which zip codes were covered by the ordinance requiring registration of vacant buildings and they provided the following information. These zips codes fall completely within the city of Albany and all vacant properties in these areas are subject to the registration ordinance:

The following zip codes fall only partially within the city of Albany and may also be subject to this ordinance in some cases. The city indicated that for these zip codes, if there is any uncertainty as to whether it falls within Albany's jurisdiction, they will provide clarification based on the address.
