City of Cleveland Proposed Legislation Deed Filing

As previously discussed, State Rep. Mike Foley and Rep. Louis Blessing Jr have introduced HB 138 regarding judicial sales of real property/delinquent real property and the transfer without sale.

A fifth hearing on this Bill was recently conducted at the Ohio House of Representatives during the House Civil and Commercial Law Committee Meeting.

Following is a summary of the bill in its current form.

Ohio HB 138 proposes to amend various sections of Ohio Revised Code and enacts additional sections to:
  • require purchasers of real property at a judicial foreclosure sale to provide certain identifying information
  • allow municipal corporations to conduct inspections of property subject to a writ of execution
  • require judicial foreclosure sales to be confirmed within 30 days of sale
  • require officers who sell real property at a judicial foreclosure sale to file a deed within 14 days of confirmation
  • authorize courts and county boards of revision to transfer certain tax delinquent lands subject to judicial foreclosure without appraisal or sale
  • permit a summary property description to be read at a judicial sale, and 
  • offer property that did not sell at a judicial foreclosure sale to a political subdivision before forfeiture to the state
  • expands the powers of County Treasurers to provide standing  to bring a civil action in Common Please Court to enforce a tax lien on tax delinquent premises.  That action also may be brought in a municipal court with jurisdiction or in the county board of revision and that the action may be for the sale of the premises (existing law) or the transfer of the premises to an “electing subdivision.
  • expands the powers of County Prosecutors  bring a foreclosure action in court in the name of the County Treasurer to state tax liens on delinquent lands or delinquent vacant lands.  The action also may be brought in the County Board of Revision with jurisdiction and that the proceeding may be for the sale of the lands or the transfer of the lands to an “electing subdivision.”
