Minnesota H.F. No. 3474 Premises Abandonment Circumstances Provided

Governor Tim Pawlenty recently signed H.F. No. 3474. affecting the Redemption Period in the State of Minnesota.

Language has been added to Minnesota Statutes 2006, section 582.032, subdivision 7 providing that if a defendant fails to appear at a hearing on a mortgagee's request for a reduced redemption period, and the mortgagee has made the request based upon a claim that the property is abandoned, then the defendant’s failure to appear is conclusive evidence that the property has been abandoned.  For this provision to apply, the defendant must have received proper notice, consistent with the requirements for service of process in a civil action.
