On June 3,2008 Hawaii Governor Linda Lingle signed HI S.B. 2454 into law. S.B. 2454 amends the state's nonjudicial foreclosure laws.
Under the amended law:
- a mortgagee desiring to foreclose under a power of sale or alternate power of sale must be represented by a licensed attorney who is physically located in Hawaii.
- the foreclosing mortgagee or attorney must provide certain information to entitled parties upon request, including:
a) the amount necessary to cure the default;
b) the date and time of any postponed foreclosure auction and;
c) the sale price of the mortgaged property after the foreclosure auction.
