Freddie Mac has issued the following Single Family Seller/Servicer Guide Update regarding Bulletin 2009-11

With today's Single-Family Seller/Servicer Guide (Guide) Bulletin 2009-11, we are providing additional instructions, modifications and revisions to our delivery instructions, updating forms in the Guide to assist you in meeting our eligibility and delivery requirements, and making changes to our servicing requirements in response to today's market conditions.

You'll find complete details on the following changes in today's Guide Bulletin available on FreddieMac.com:

  • Additional instructions, modifications and revisions to our delivery instructions. To address data delivery issues you've helped us identify, we are providing additional instructions, modifications and revisions to our delivery guidelines to assist Sellers in providing accurate and complete data for the mortgages you deliver to us. The revisions affect the delivery of certain loan data required by Form 11, Mortgage Submission Schedule or Form 13SF, Mortgage Submission Voucher.

  • Latest version of FEMA Form 81-93 incorporated into the Guide. We are incorporating the latest version of Federal Emergency Management Agency (FEMA) Form 81-93, Standard Flood Hazard Determination into the Guide, which FEMA approved for use in December 2008. FEMA requires that all flood zone determinations made on or after June 16, 2009 be documented on the updated form. While there are no content or format changes, the new form has an expiration date of December 31, 2011.


  • Extended timeframe for submitting Form 104SF and Form 104DC. In response to the unprecedented volume of workouts that Servicers are processing, we are temporarily extending the timeframe for submitting expense reimbursement claims for both non-REO and REO expenses. Effective immediately, Freddie Mac is extending the timeline to submit Form 104SF, Statement of Loan, Workout and REO Expenses and Income, and Form 104DC, Designated Counsel/Trustee from 30 to 45 days.

    In addition, with this Guide Bulletin, we are providing additional guidance regarding two income codes in Guide Exhibit 74, Expense and Income Codes for Form 104SF.
  • Form 981 updated to include special provisions for modified mortgages. When there is a transfer of servicing on a mortgage modified under the Home Affordable Modification Program, Servicers must indicate on Form 981, Agreement for Subsequent Transfer of Servicing of Single-Family Mortgages, whether the modified mortgage has an interest rate reduction that falls below the market rate or a partial forbearance. Form 981 has been updated to make the selection of these provisions available.

  • Title work expenses limit increased in North Dakota and South Dakota. Due to rising title costs in these states, we are increasing the limits for title work expenses to $300 in North Dakota and $350 in South Dakota.

Other Guide changes announced in Guide Bulletin 2009-11

With today's Bulletin, we are also making the following changes:

  • Reinforcing the requirements in connection with executing notes on behalf of a living trust.
  • Deleting Guide Exhibit 7, Electronic Transmissions, which is now obsolete.
  • Providing additional details regarding the circumstances in which servicing of a delinquent mortgage must be relinquished to Freddie Mac.
  • Updating contact information in Guide Directory 3 for you to utilize for transfer of servicing concerns.
