Synopsis: Landlord must provide written notice to tenant of a foreclosure sale at least 30 days before the sale.

 

Definitions:

Landlord: “the owner, lessor or sublessor of the dwelling unit or the building of which it is a part, and it also means a manager of the premises who fails to disclose as required by section 33-1322.”

Tenant: “a person entitled under a rental agreement to occupy a dwelling unit to the exclusion of others.”

Details:

- Specific wording of notice: “This property is in foreclosure and your right to continue to live in this property may be affected.  If this property is sold at a foreclosure sale, the new owner may cancel any lease you have and you may be required to move.”

- Rescheduled sale: Landlord must provide written notice if the sale is rescheduled.

- Penalty: Knowingly failing to provide notice is a class 1 misdemeanor.
