Amending: adds section 1940.95 to the CA Civil Code
Synopsis: Requires the landlord to notify a tenant at the time of the rental agreement, if the unit is subject to any (a) outstanding notice of default, (b) pending foreclosure lawsuit, or (c) pending proceeding to foreclose on a tax lien.
Outline:
- At the time of the execution of the rental agreement of a dwelling unit (single-family or multifamily up to 4 units), the landlord must disclose to tenant in writing if the property is subject to any:
a) Any outstanding notice of default
b) Pending foreclosure lawsuit
(c) Pending proceeding to foreclose on a tax lien
- Tenant remedy. If tenancy terminates as a result of one of these circumstances and the landlord failed to notify the tenant of said circumstance, then the tenant may recover all prepaid rent and the great of a) twice the actual damages, or b) twice the monthly rent.
